How child support is calculated in Indiana

Indiana’s Child Support Guidelines follow the income shares model: each parent’s weekly gross income is adjusted, the parents' combined weekly adjusted income is matched to the Supreme Court’s weekly support schedule, and the obligation is prorated between the parents by their share of income. A parenting time credit applies from 52 overnights a year.[1]

The rules behind Indiana’s numbers

The guideline is Indiana Child Support Rules and Guidelines, Guideline 1 (Preface). Open each rule to read the exact words.

Income counted

Weekly gross income (actual or potential, plus in-kind benefits)

Indiana works from each parent’s weekly gross income from almost any source, including potential income if a parent is unemployed or underemployed.[2]

Official text · Ind. Child Support Guideline 3A

“For purposes of these Guidelines, "weekly gross income" is defined as actual weekly gross income of the parent if employed to full capacity, potential income if unemployed or underemployed, and the value of "in kind" benefits received by the parent.”

Shared parenting time

Parenting time credit starts at 52 overnights a year

The noncustodial parent receives a credit for overnights, using a Parenting Time Table that begins at 52 overnights a year (alternate weekends) and rises up to equal parenting time.[3]

Official text · Ind. Child Support Guideline 6

“The Parenting Time Table (Table PT) begins at 52 overnights annually or the equivalent of alternate weekends of parenting time only.”

Top of the guidelines

Schedule to $9,200 combined weekly adjusted income; above it, fixed percentages (8.1% for 1 child … 20.4% for 8)

The weekly schedule runs to $9,200 of combined weekly adjusted income; above that, the schedule lists a percentage of income for each number of children.[4]

Official text · Guideline Schedules for Weekly Support Payments

“Percentage 8.1% 11.4% 13.1% 14.7% 16.2% 17.6% 19.0% 20.4% 50.0% of Support if Combined Income Greater than $9,200”

Departing from the guideline

Rebuttable presumption; parenting time credit not automatic

The schedule amount is presumed correct, and the court should check that applying the parenting time credit will not jeopardize a parent’s ability to support the children.[3]

Official text · Ind. Child Support Guideline 6

“There is a rebuttable presumption the support calculated from the Guideline support schedule is the correct amount of weekly child support to be awarded.”
