Divorce mediation is a process in which a neutral mediator helps spouses work out the terms of their divorce, such as parenting time, child support, property and debts. The mediator doesn't decide anything. If you reach an agreement, its terms are written down for you to sign and, in a court case, to file with the court.

It depends on who you hire and where. Private mediators set their own rates, by the hour, per session or as a flat fee, and some court programs set fees by law. Yes. Parents often use mediation to work out a parenting plan: where the children live, the schedule, holidays and how decisions get made. Some courts require parents to try mediation before a custody hearing, with exceptions for domestic violence. A judge usually reviews the final plan before it becomes an order.

You can usually mediate without a lawyer, but the mediator can't give either of you legal advice. You can hire your own lawyer to advise you before, during or after mediation, or to review the agreement before you sign. Some mediators are lawyers themselves; they still act as neutrals and don't represent either spouse.

Mediation may not be safe or fair when there has been domestic violence, threats or coercion, or when one spouse can't speak freely or is hiding assets.
