Mediation and ADR

Appellate mediation

Mediation that takes place while an appeal of a civil case is pending, after the trial court has ruled.[1]

In more detail

Florida's mediation statute defines appellate court mediation this way and lists it alongside circuit, county, family and dependency mediation.[1] Virginia's appellate courts began an appellate mediation pilot in 2019, scheduled to run through 2025, for selected civil cases in which both sides have lawyers.[2] Mediation at this stage can settle the case, or narrow the issues, before the appeal is decided.

Varies by state

Whether an appellate court offers mediation, and for which cases, depends on the state and the court. Find your state’s rules.
